On 15 September 2011, the General Court rejected the action initiated by the European Steel Association (EUROFER) and five steel companies to suspend the European Commission Decision on the rules for the free allocation of emission allowances for industries covered by the EU Emissions Trading Directive (ETDi) while the Court decides on the legality of the Commission decision. This clears the way for the EU to allocate permits to Europe’s energy-intensive industry in the third phase of its cap-and-trade scheme, starting in 2013.
