In its response, the Association highlighted the fact that, in the EU, greenhouse gas (GHG) emissions roughly occur one third from industry, one third from households and one third from transport, some balance needs to be kept between these contributors when tackling GHG emissions.

In early December 2010, CEMBUREAU was pleased to learn that the European Commission has decided not to continue any further work on the introduction of an Emissions Trading Scheme for NOx and SO2 from industrial installations. Although the Commission felt that the consultancy studies had shown that emission trading offers a more cost-effective alternative to BATi-based (Best Available Technique) permitting, they recognised that there were also drawbacks.

On 20 December 2010 the Council authorised the European Commission to open negotiations with the Swiss Confederation for a link between the EU and the Swiss greenhouse gas emissions trading systems (ETSi). This mandate will allow for negations to start in 2011.
This is the first time that the EU seeks a connection with an existing such scheme, whilst at the same time complementing the extension of the EU trading scheme to Norway, Liechtenstein and Iceland.

ECHA receives over 3 million C&L notifications
Upon the expiry of the deadline of 3 January 2011, the European Chemical Agency (ECHA) received 3.1 million Classification and Labelling notifications covering a total of 107,067 different substances. All companies manufacturing or importing hazardous substances were required to classify them by 1 December 2010 and notify ECHA by 3 January 2011.

On 7 December 2010, the European Commission adopted the new Communication on the review of the Community Strategy Concerning Mercury. In reviewing the 20 actions contained in the 2005 strategy, the communication highlights that significant progress has been made in terms of implementing these actions.

Energy Efficiency Action Plan to be adopted on 2 March 2011
The Commissioner for Energy Guenther Oettinger has confirmed the adoption of the Energy Efficiency Action Plan for 02 March 2011 in his intervention in the European Parliament Industry, Research and Energy Committee meeting on 26 January 2011. Concrete legislative proposals are expected to be proposed after the summer 2011.

Some progress made at Cancun climate talks
Several concrete agreements were made at the latest round of climate change negotiations in Cancun in December. In its press statement, the UNFCCC secretariat (United Nations Framework Convention on Climate Change) claimed that ‘a balanced package of decisions that set all governments more firmly on the path towards a low-emissions future and support enhanced action on climate change in the developing world’ had been adopted.

While most of the data has already been published separately in recent months, this is the first time it has been put together in one document. On 18 November 2010 the European Commission adopted a regulation revising rules of origin for products imported under the Generalised System of Preferences (GSP). Rules of origin are used to determine whether imported goods really originate in countries covered by the EU’s preferential trade arrangements, thereby making them eligible for a preferential customs tariff. This regulation aims to considerably simplify these rules to enable developing countries to understand and to comply with more easily and the new rules will apply from 1 January 2011.
