Industrial Emissions Directive (IPPC recast)

Following its adoption as an A item by the COREPER on 5 November 2010, the Justice and Home Affairs Council approved on 8 November the revised directive on industrial emissions. In accepting all amendments the European Parliament voted at second reading on 7 July 2010, the Council has now ensured the adoption of this law.

On 17 December 2010, the Industrial Emissions Directive (IED) was published in the Official Journal and entered into force on 6 January 2011.

The proposal on industrial emissions aims to improve health and environment protection, while making the rules clearer and easier to implement. It updates and merges seven pieces of existing legislation, including the Incineration of Waste Directive and Integrated Pollution Prevention and Control (IPPCi) which covered the manufacturing of cement and the co-processing in cement kilns.

To receive a permit, installations covered by IPPC rules must apply “best available techniques” (BATs) to optimise their all-round environmental performance. Emissions to air, soil or water, as well as noise and safety are all considered. The compromise reached between the Parliament and Council foresees flexibility for competent authorities but sets tougher conditions for deviating from the use of BAT. The compromise also reviews permit conditions and facilitates the review of the legislation to reflect the development of scientific data and best available techniques.
